Another one for the pundits - Once an operator tests positive for drugs by law under the FMSCA and DOT he is no longer a CDL driver, However the Government in their wisdom has made any subsequent employer the enforcer of the law.  What should we as an industry do to insure there are no positive tested operator/drivers in the work force.  Should the industry lobby the Government to have a central reporting agency so that once a driver is terminated for failing a drug test and refusing treatment he can no longer have his CDL?

C.P.: Isn't the TRUE ethical question here why the goverment has the right to deem an operator unsafe for what he does in his offtime?He can drink himself into oblivion two days running,but if he partakes of the green stuff he is forever unfit to operate mobile equipment! Don't get me wrong,just playing devil's advocate here.I do believe there are other more harmful substances being abused everyday by people in the industry ,but I think alcohol is one of the MOST dangerous drugs around! It just has better lobbyists
