Dear Members,

Over the past few months, the ACPA has received several reports of stepped-up scrutiny by the IRS in regards to Federal Excise Tax (FET) on concrete pump chassis. This is a hugely important issue to our members. For the IRS to change its traditional view that concrete pumps are considered mobile machinery and exempt from FET would be devastating to our industry.

To help ACPA keep on top of this situation and effectively challenge this unjustified IRS action, it’s important for us to know how big a problem this is and what type of equipment the IRS may be targeting. It’s also important for any concrete pumper in this situation to fully consider their legal and tax options and not hand the IRS an easy victory with a check on an audit finding which may not be justified. 

Please advise Christi Collins (christi@concretepumpers.com) at the ACPA National Office if your company is getting pressure from the IRS on a concrete pump FET issue. All information will be held confidentially and not shared without specific permission. Although ACPA cannot give direct legal advice, we can discuss the tax issues involved and what the IRS may or may not be up to. Your input can help shape ACPA’s legal and public policy response to this challenge.
