Terms and conditions, like the laws they are written to protect you from are different state to state. There is no one size fits all set of terms and conditions.

Go to the largest pumper in your area. Ask him for the terms and conditions he uses. My guess is that he will give them to you. If he will not... well there are other ways you could go about it. Ask first.

Take the terms to your lawyer, if you don't have one you should. Or go to your insurance company and ask them what specific protection they would like to have on your invoice (job ticket). My point is that you are correct in asking about this. The work you do now will save you thousands in the future. To say you can not afford to have this done is short sighted. If you are an ACPA member (EVERY ONE SHOULD BE) call them and ask for assistance. Or at least get the name of your largest competitor.

Keep working on this project; it is worthwhile. ;~)

lawyers aren't bad guys unless you are facing them in court with out a properly written set of terms and conditions.

If your in Texas im sure they will be the same as ours. I will scan ours and email you them. Ours pretty much says we arent responsible for anything that happens while we are on the job. and that we will do the best to ensure that our truck is well maintained.

Which brings me to another point. We were on a Job a few months a ago. The job had a broke down craine on it. They were still paying for it. even though it wasn't working. I was doing a pipe job and the concrete company sent me some trash, i had to break down my reducer like 8 times. and the pour took about 2 hrs longer than usual. they didnt want to pay for the time i was down but they were paying for that crane that was down.

i have taken other work orders and rewriten them enough times that i have come up with this.

fundamental guideline for pump service

1,delivery conditions are site access-blocking of right of way-going off road-operating on a slopeand towing needs.

2,roller mixer drivers point of delivery is listed as pump.

3,operator employment is $90- per hour with a two hour minimum.

4,start time is typically thirty minutes before truck time.

5,stop time is when the equipment is clean and loaded-plant wash charges apply.

6,terms are collect on delivery.

7,no conract or insurance certificates are charged to job.

8,no back charge apply-damage clause.

9,thiry day notice is given for labor claims.

10,back of curb rule is customers responsibility to provide hose tender-water supply and waste containment-eye protection is recomended.

11,washing of tools and boots are not allowed in the street

12,project address-customers approval-date.

if you let the customer run up a tab on a hand shake, bend over because they will call the other guy for sevice.
