That is the most obvious case of discrimination I have seen in a while.When any employer thinks that his political beliefs must be mirrored by his employees, and forbids what otherwise would be acceptable because of the difference..................... im tired of hereing this crap about nobody wantedto do the job for a small wage. when u dont pat taxes, If thats the case, and someone can do it for said amount then u can do it. if the company doesnt have another operater torun the machimne, i guess its ok to let it sit? This is the beauty of a non union work place you can be let go for anything.If the boss says no thats the way it is. Vacation time is a gift from the employer. where in the federal labor laws does it state that you must provide paid time off? Also he was not fired he quit so the job must not have been that important to him. I wanted off to attend a vetrans day service onw year but the boss said no, It was important to me to go but feeding my family was more important so I made my decision and manned up and went to work, The parade or what ever it was must have been more important to this guy than feeding his family. And come on lets be real how long is a boom pump operator really out of work? As long as it takes to make a couple phone calls. I am sure he is working somewhere else already.when in doubt wash out.

BobI do not agree with you that a law was violated,at least in CA.Its employment AT WILL.If time off is not approved by the employer then thay is it.The employer in this case also stated that the employee was trying to impact his buisness financially!The employer accually agreed to let the employee take vacation days off at a different time ,maybe at a time that would not impact the $$$ of the buisness.He was not sick, the sole purpose was what??The employer has the right to run his buisness and the employee has the right to work or not.Iam sure you will have a 3 page responce and you do also have that right.The employer as well has his.

I am in agreement with Bob. This story that is developing is not about the immigration issue but rather about discrimination. I have been on the Web searching for data to support Patriot and have made several phone interviews with other pump companies. I am struggling to come up with a plausible concept as to why Pat would do such a thing. To date I can only find prejudice.

I never said I was in favor of amnesty. These people were minding their own business, living all over Mexico. (Just for the sake of argument, let us assume they were making $60.00 per month). Then we lured them to the assembly plants we built just south of the border where they could make $60.00 per week. << we then moved the assembly to China>>. The problem with your analogy is that Patriot did not let Julio Samaniego up to bat. This is the entire shame of the article. Furthermore you remarks are inaccurate. Re-read them, they are inaccurate. You contradicted yourself. In addition there were a minimum of three veterans that defended the American Flag at the company in mention. Only one is gone and he was Hispanic. Check the long term history of May 1 as a historical date for labor movement issues. Emphasis on long. There were many other options available to Patriot here. In fact in an abuse of power the first thing you look at is available options to the parties. Julio was not going to cripple Patriot. This was an embarrassment to the Industry and the diverse work force that we deal with. To not let them have one day, (with notice) ,and Julio Samaniego in particular is wrong.

Lets all take a day off and protest the following, hand in hand and side by side:1. Our troops are overseas fighting terrorism and our borders are wide open and anyone can walk across, anyone that may have good or bad intentions. This should be supported by all who love this country.2. Our government cannot come up with a streamlined, simple, efficient, effective and verifiable system for workers and employers to utilize for guest working. This should be supported by every consumer, worker and employer.Once we can fix these two things, we can tell anyone who is illegal to get their guest worker card and get legal. Also, once we have a working system, we can severely punish an illegal worker and employer who hires a illegal worker.Newt Gingrich has often endorsed turning the guest worker program over to civilian institutions, such as Bank America. The government will not be able to run this system effectively. I have personal first hand knowledge of the governments inability to run a immigration system. Let the government secure the borders, let BofA or Capital one etc run the program with government oversight.we can argue a point for ever while the politicians sit on this issue. The Minutemen down in Arizona got it right. They care about the country. Get our Troops mobilized on the border, get it secure and also get a guest worker program (not ran by the government).

It is not about politics. All concrete pump companies are in the same battle. The battle for qualified operators and workers. Here and in the patriot story a owner took the stand against a US citizen, a hard worker and brought politics into the foreground. It is imperative that the Hispanic population recognizes that this is a isolated incident and is not indicative of the remainder of the industry. Reference and read the page five of the Patriot Story...How successful companies are accommodating the diverse workforce. In a related story in the New York Times...as many as half of the roughly 5,000 private firefighters based in the Pacific Northwest and contracted by state and federal governments to fight forest fires are immigrants, mostly from Mexico. And many of them are workers here illegally.
