We are in the process of overhauling our Job Ticket form that the contractor signs on the jobsite. This includes a 3/4 page of "Cover Your A**" fine print on the back. I would like to see some other company tickets to compare to what we have as far as fine print is concerned, Safe set up, clean out requirements, overhead hazards, driving beyond curb line, ect.

Im not asking for your rates here. Im just curious what you make the contractor sign before pumping begins.

Contractor to whom we are providing services, (space for name here) shall be responsible for containment of any and all washout, as well as provide proper containment of spillage or runoff. Any runoff or discharge to any watershed or storm drain is against the law and therefore the sole responsibility of contractor.  Contractor is hereby notified and agrees to indemnify and hold harmless, (your name) against any actions should contractor fail to comply.

I'd say cover your ass with some Water Pollution disclaimer.  definitely not an attorney and I don't play one on TV, so this needs better verbage, but you get the point.

Your fine print depends on state of operations, as each has different laws regarding indemnification. 

Your general liability insurer should be able to provide a good sample ticket or suggested language, I know that USI does this. 

Some of the easiest changes to make though, are requiring a contractor to sign BEFORE you set up and AFTER you set up. The BEFORE puts into effect the fine print on the back, because after something goes wrong, you will be hard pressed to get a signature.

I had a page set up of numerios issues but the classic one had to do with their conduct towards me as the hourly employee so no shift of liability or oweing the project. As for insurance it needs to be stated as requirement of job and negociated in advance of providing service.   Also you cannot contractual excule liabity in the state of oregon.

also state on there you have the right to refusal of a job if the job conditions are unsafe. You will be given a safe area to setup the pump, and a designated area to clean out the truck. You will not be charged for delays in concrete supply, changes in slump, etc. You wont be responsible for back charges of any kind including damages to property. State your fuel charges, cancelling needs to be given in writing to your address 24-48 hours before job start, otherwise a fee will be charged for losing possible work. also put something in there about not being liable if someone dies while your on the jobsite. Pretty much whatever you can think of to cover your own butt
