Dear Concrete Pumpers,

This letter is a request for information from you regarding an issue which will greatly affect us all.  On January 1, 2006 the California Air Resources Board (CARB) closed registration for all off-road engines larger than 50 hp which are not current Tier certified.  The current Tier certification for all engines over 50 hp is Tier 2.  For most concrete pumps 50-100hp, Tier 2 engines were only manufactured after 2004.  You can get more information on this program at www.arb.ca.gov/portable   If you currently own a Tier 2 pump (Built in 2005 or 2006) please get your pump registered ASAP.  You will need to fill out a Form 1 and Form 2 on their site.  If you own an older pump, please continue reading.

What this means for you:

1.       In most cases, only engines built after 2004 will be able to be registered with the state. 

2.       You can find your engine manufacture date by looking at the 12 digit engine family number stamped directly on the engine.  The first digit correspond to the year the engine was made (i.e. 4dzxl06.1038 is an engine manufactured in 2004).

3.       If you CAN’T get your engine registered with the state, you will be forced to register it with each individual county pollution district which you service.  Since you failed to register with the state, and don’t meet the current tier requirements, you will be forced to sign stipulated agreements which mean that you will HAVE TO REPLACE YOUR ENGINE BY 2009 in most cases.

4.       Either way, by 2010-2013, you will have to meet the California Air Resource board averaging requirements.  This means that your fleet will have to have an average of Tier 2 engines on all your machines (i.e. a Tier 1 engine and a Tier 3 engine will average out to a Tier 2 engine for your fleet).  If you only have one or two pumps that were built in 2003/2004, you will have to replace the engines on your machines by 2010-2013 (I get different dates on exactly what the averaging requirements will be).

I am currently in talks with the California Air Resource Board to convince them to reopen the registration period.  However, they are convinced that Performance Concrete Pumping is the exception and not the rule.  IF YOU KNOW SOMEONE WHO HAS TIER 1 OR OLDER ENGINES AND WAS NOT AWARE OF REGISTRATION REQUIREMENTS AND DOES NOT HAVE THEIR MACHINES REGISTERED…….PLEASE HAVE THEM SIGN THIS FORM AND FAX IT (916) 681-8393 OR EMAIL IT parsons5ca@frontiernet.net .

CARB is concerned more about numbers than individuals.  If we can stress to them the magnitude of the problem, I am confident that they will rethink their policies.  Furthermore, if you know a contractor or pumper who entered the state after Jan 1, 2006, I would like to get into contact with them. 

Furthermore, I am EXTREMELY interested in Pumpers in the same situation we are in who brand new purchased pumps in 2004 or 2005 with Tier 1 2003 engines in them. 

This legislation is not confined to Concrete Pumps.  It affects all portable machinery with engines over 50 hp including but not limited to air compressors, generators, stump grinders, welders, concrete saws, and many many more.  Ask around, and have all contractors affected by this contact me.  

None of this information will be given to the Air Resource Board.  Instead it will be a tool for me to get a handle on how many companies are actually affected by this new legislation.  CARB has done a terrible job in contacting those who will be affected by it. 

We are currently facing a $10,000 fine from Placer county Air Pollution district in relation to this.  Furthermore, I have been told that the actual fine could be as high as $10,000 PER DAY.  It is not a joke.  This could ruin the Concrete Pumping Business in the state of California. 

I am hopeful that we will be able to re-open the registration period.  However, CARB will not reopen it without numbers.  I am hoping to accomplish this for future meetings, which you are all welcome to attend.  An outreach meeting is scheduled for Sept 6, 2006 and the next board meeting is on Sept 28, 2006.  There will be a time for public comments at the end of the board meeting.  I am hoping to have as many of these by Sept 28th as I can.  PLEASE SEND THEM IN TODAY.

Wow!  It likes you Ca. pumpers have some tough choices.

You can sit back, let others make the effort and hope everything works out for the best, (it usually does not), or you can take matters into your own hands and try to control your own destiny.

If you choose the latter, then the first thing to do RIGHT NOW is to fill out the form at the end of the article and send it in.

Next, follow the links in the article and learn for yourself what the regulations are  and  how they apply to you.

Next, determine the relevent facts about the engines you are using, make, model, s/n, etc, a what "tier" they are in. 

If it looks like you have a problem, start researching a solution. How much will a replacement engine cost?  Will it make more sense to replace the pump?  Get prices on a replacement pump, new, or a later model used one.  Find out what your pump is worth now, as a trade-in, or on the used pump market. (Be sure to check www.usedconcretepumps.com. )

Do these things now.  The closer the deadline gets, the more the solution is going to cost you.  New pumps and new engines will cost more, higher demand for both will make it harder to make the changes, and your pump will lose value as the market becomes flooded with used pumps.

If CARB does reopen the registrations you will have lost nothing except a little of your time.  If they do not you will be prepared to solve your problem quickly, ahead of the crowd.  You will save significant money and, perhaps, your business.

In any case, get the form at the end of the article filed out and sent right now.  This is your problem and the solution is yours also.

Okay, are we all going to show up at the state capitol with our pumps in protest.....as China and the rest of Asia grows we will not be able to meet air quality standards.  The jet stream will push the pollution to California; therefore we will be forced into being a third world country by whacko laws, while Asia expands and prospers....

Here is REED's Letter that they are sending out to all of their customers in California.

 

URGENT MESSAGE FOR OWNERS

OF PORTABLE CONCRETE PUMPS!

 

         If you have not registered your concrete pumps with the California Air Resource Board (CARB) or your local Air Quality District and your concrete pump is a model year 2002 or earlier, you could be subject to substantial fines and penalties.

 

         In 1997 a statewide Portable Equipment Registration Program (PERP) was established by CARB. It allows equipment owners who work in more than one local Air Quality District to register once with the state, as opposed to registering with each Air Quality District. Under the previous regulation, you would have to register in every district. PERP allows CARB to monitor the compliance with the new measures and requires owners of portable diesel-fuel engines to report this information to CARB.

         In the last week we have been advised that CARB allowed owners of older equipment (with Tier 0 and Tier 1 engines) to register their engines with the state up through Dec. 31 of last year. Apparently owners of this equipment are not eligible for registration with the state any more. Owners of relatively new equipment (with Tier 2 engines) are still eligible to register with the state.

         It is illegal to operate older equipment that is not registered with either CARB or the local Air Quality District. The local Air Quality Districts are responsible for enforcing these regulations and for evaluating the amount of the fine(s). If you are operating without permits, then you will be subject to penalties determined by the local Air Quality District. This judgement is based on the specific circumstances of the violation(s) and their interpretation of the California Health and Safety Code as it applies to these circumstances. The penalties start at less than $1000.00, but can be upwards of $10,000.00 per day per violation. Penalties can also include forfeiture of the right to operate this equipment in the state of California.

         For owners of equipment containing a Tier 2 engines (engines that burn clean enough to be eligible for registration now), you should register as soon as possible. Eligibility for REED products is described below:

         A Series Pumps: serial numbers where the last four digits are 2140 or higher

            (A Series Pumps will be eligible for registration until the end of 2007)

         B Series Pumps: serial number where the last four digits are 2142 or higher

                (B Series Pumps will be eligible for registration until the end of 2007)

         C Series Pumps: serial number where the last four digits are 2107 or higher

                (C Series Pumps will be eligible for registration only until the end of 2006)

        

         Information on how to register is available from the CARB website at http://www.arb.ca.gov/portable/perp or by contacting the CARB direct at (916) 324-5869, or REED at 909.287.2100.

        

Those customers who own REED equipment that is not eligible for State registration, we suggest that you contact your local Air Quality District to find out what you can do to get a permit with them. At the very least you will be able to work inside your own district, without fear of penalties, once you have figured out the requirements for acquiring a permit. For older engines this process may involve costs for retrofitting or supplementing your emissions system. Generally..the older the engine, the more costs will be involved. Each district will have different requirements. Some will be very difficult and some will be very easy to deal with.

         REED and The ACPA will represent concrete pump owners at a meeting with CARB officials on September 28, 2006. At this meeting we will petition the board to re-open the registration process for those who own equipment that is not eligible for registration at this point (older equipment). We need immediate response from these customers so that we can describe in detail the magnitude and seriousness of this situation. Please fill in the enclosed questionare and return it to us as soon as possible.
